I don’t know whether you were aware of the fact, but Myriad Genetics patented a human gene as a breast cancer test (as many others, the Canadian public health system couldn’t afford to use this test).
Some challenged this patent in court and there is a ruling stating that the patent is invalid. The court ruling isn’t final and the US Supreme Court is likely to review the case.
The USPTO supports Myriad Genetic, but the US Government wrote an amicus brief arguing that human genes are body parts and as such they aren’t patentable.
I guess that the final ruling will declare the patent invalid.
Is this an allusion to the farmer who was sued for (passive) plagiarism of a neighbor’s GM pollen?
